Unlawful Property Intruder Law in Saratoga County

The Saratoga County Board of Supervisors has now passed a law to address the spread of squatters taking over properties in New York and around the country. In April, the Town of Clifton Park instituted its own law to protect property owners. We have experienced situations involving squatters in Clifton Park and other areas of Saratoga County. This proactive step to provide a clear, concise, easily enforceable law will make it clear this behavior will not be tolerated in Saratoga County. According to a recent Channel 6 news story, Albany Police recorded 96 incidents involving squatters and potential squatting incidents in 2023, and so far in 2024 they have recorded 41. Most police departments have not maintained records for offenses in this category, but that is changing. Particularly since now more municipalities will now have laws that more clearly define the behavior. Squatting incidents have nothing to do with landlord/tenant rights, although some attempt to confuse the discussion by stating there are already laws on the books in NYS governing landlords and tenants. In Saratoga County, if you enter a property unlawfully in the first instance you will never attain tenant rights as we have watched occur in other jurisdictions.
